Intellectual Property Claim
Intellectual Property Protection Policy
Effective Date: May 27, 2025
At Kalulan, we respect and are committed to protecting intellectual property rights – whether they belong to creators, artists, businesses, or our own community members. This Intellectual Property Protection Policy outlines how we handle claims of infringement and what we expect from users in terms of content ownership and usage.
1. Our Commitment to IP Protection
We take intellectual property (IP) rights seriously. Whether it’s copyright, trademark, design rights, or patents, we strive to:
- Ensure that the content on our platform does not infringe on third-party rights.
- Respond promptly to valid complaints or takedown requests.
- Educate our users about the importance of respecting creative ownership.
- Take proactive measures to detect and discourage the distribution of counterfeit, pirated, or unauthorized goods or content.
2. User Responsibilities
When using our Services, you agree that:
- You will not upload, list, or share any content that infringes upon the intellectual property rights of others.
- All products, artwork, logos, or written material you post must either be owned by you or licensed to you.
- If you believe you have the legal right to use certain IP, you must be prepared to provide proof of authorization upon request.
If you submit or publish content on our platform, you grant us a limited license to use that content for the operation and promotion of our services, as described in our Terms of Service.
3. How to Report IP Infringement
If you believe your intellectual property has been used without permission on our platform, you can file a formal complaint with us. Your notice must include:
- Your full legal name and contact information
- A detailed description of the intellectual property allegedly infringed
- A link or clear reference to the content in question
- A declaration under penalty of perjury that your claim is accurate and that you are the IP owner or authorized to act on their behalf
- Your signature (physical or electronic)
You may send the claim to:
Email: support@kalulan.com
We will review your complaint and take appropriate action, which may include removing or disabling access to the disputed content and warning or suspending the responsible account.
4. Counter Notification Procedure
If your content has been removed or disabled due to a complaint, and you believe it was a mistake or you have legal grounds for use, you may submit a counter notice. This must include:
- Your name and contact information
- The content removed and its location before removal
- A statement, under penalty of perjury, that you have a good-faith belief the content was wrongly taken down
- Your consent to jurisdiction in the relevant court
- Your signature
We will forward your counter notice to the original complainant. If they do not pursue legal action within a specified time frame, we may restore the content.
5. Repeat Infringer Policy
We maintain a strict policy against repeat infringement. Accounts that receive multiple substantiated IP complaints may be suspended or permanently terminated. This applies to:
- Repeated unauthorized use of copyrighted material
- Sale of counterfeit or trademark-violating goods
- Use of others’ branding, logos, or identity without permission
6. Education and Awareness
We aim to foster a respectful, informed user base by:
- Sharing guidelines on how to avoid IP infringement
- Providing resources about copyright, trademarks, and fair use
- Encouraging original creativity and responsible commerce
7. Disclaimer
We are not legal advisors and cannot mediate IP ownership disputes. We reserve the right to remove any content or suspend any account suspected of infringement, even without a formal notice, if in our sole judgment it violates our policies or the law.
